Canada proposes changes to immigrant entrepreneur visa program

Canadian Citizenship and Immigration Minister Jason Kenney announced the department would be discussing the possibility of bringing in changes to the immigrant entrepreneur scheme. Citizenship and Immigration Canada’s current immigrant entrepreneur program has been suspended since 1 July 2011.

“Our Government’s top priority remains jobs, growth and long-term prosperity. Canada cannot afford to lose out in the competition for foreign entrepreneurs among immigrant-receiving countries,” said Kenney. “We need to proactively target a new type of immigrant entrepreneur who has the potential to build innovative companies that can compete on a global scale and create jobs for Canadians.”

In the coming months, CIC said they plan to consult with industry associations in the development of a new “startup” visa program for entrepreneurs.

Australian Immigration proposes more changes to student visas

Australia’s Department of Immigration and Citizenship (DIAC) announced on 19 March further changes to student visas including streamlined visa processing and other changes that are intended to go into effect on 24 and 26 March 2012.

The proposed changes are part of stage two of the Australian Government’s response to the Knight Review of the student visa program. Stage one was implemented last November.

Under the changes, student visa applicants can streamline their visa application if they submit them with a Confirmation of Enrolment from a participating university in Australia at Bachelor, Masters, or Doctoral degree level on or after 24 March 2012.

Australian immigration announces changes to the permanent employer-sponsored visa program

Australian Immigration and Citizenship Minister Chris Bowen has announced significant changes to simplify the process for the permanent employer-sponsored visa program.

changes will affect the following visas:

  • Employer Nomination Scheme visa Subclasses 856 and 121
  • Regional Skilled Migration Scheme visa Subclasses 857 and 119
  • Labour Agreement visa Subclasses 855 and 120

The Australian government will create a “fast-tracked” path from temporary skilled 457 visa-holder to permanent resident under the employer-sponsored visa system. Additionally, the current six permanent employer-sponsored immigration visas will be replaced by two new visas: Employer Nomination Scheme (subclass 186) and Regional Sponsored Migration Scheme (subclass 187).

EB-5 Investor Visa: Sources of Capital

The U.S. Immigration and Nationality Act sets aside 7.1% worldwide visa numbers to qualified immigrants seeking to enter the U.S. for the purpose of engaging in a new commercial enterprise. The applicant must either have invested or is in the process of actively investing capital not less than U.S. $1,000,000 in the enterprise. This is commonly known as the EB-5 investor visa. Other categories of immigrant visa are usually oversubscribed for countries such as China and India. For instances, many family-based petitions, including those filed by U.S. citizens, are currently backlogged. The EB-2 and EB-3 employment visa categories are similarly oversubscribed.

UK immigration announces new post-study work visa for entrepreneurial students

UK immigration has announced new measures to make it easier for foreign students who have shown entrepreneurial flair while studying for their UK university degrees to remain in the UK following graduation.

The new measures, announced by Immigration Minister Damian Green, are to be brought in to address the criticism that was received following the decision to close the post-study work visa route. The Tier 1 Post-study Work Visa, which allows graduates to work in the UK for two years after the completion of their course will no longer be available from April 2012.

Australian skilled migration visa program changes coming 1 July 2012 – Apply now!

Beginning 1 July 2012, Australian immigration will be introducing huge changes to their skilled migration program. This represents the most dramatic change to the Australian immigration system in many, many years. It is expected that under the Australian immigration system fewer people will qualify and processing times will be longer. If you wish to come under the current skilled immigration programme you should apply for a skills assessment as soon as possible. You need to be ready with your skills assessment and, have passed the English language test before you can submit your immigration application.

Australian university graduates can now apply for the Post-Study Work Visa

The Australian government has announced this week that more international students will be eligible for the Post-Study work visa as part of the Australian government’s response to the Knight Review of the student visa program.

Australian Immigration announced on November 30 the new Post-Study work visa program would be available for Bachelor or higher degree graduates starting in 2013, according to a joint press release from Chris Evans, Australian Minister for Tertiary Education, Skills, Jobs and Workplace Relations and Chris Bowen, Australian Minister for Immigration and Citizenship.

“These changes bring Australia into line with arrangements in other countries and enable education providers to offer a more competitive package to international students who are seeking good quality and long-term study in Australia, regardless of their field of interest,”said Evans.

Currently, more than 80 percent of foreign students enrolled at the Bachelor degree level or above use the Temporary Skilled Graduate Visa (Subclass 485) to stay in Australia after they graduate.

New rules in effect for Australian student visas

The first stage of a series of changes in Australian student visa laws is being implemented as part of the government’s response to the Knight Review, including changes in financial requirements and the admission process.

The Knight Review is a government appointed strategic review of the student visa program to help reform the Australian immigration student visa program.

From 5 November, student visa applicants will need to include a confirmation of enrolment, issued by their intended education provider, as part of their student visa applications, the statement said.
A new ‘genuine temporary entrant’ (GTE) criterion was also implemented 5 November.
