			<content:encoded><![CDATA[<p>Many immigrants in the United States are hesitant to approach police and other law enforcement officers when they become crime victims.  For people who are in the U.S. without legal status, they try to avoid contacts with police officers for fear that their illegal status may be exposed.  Even legal immigrants are sometimes afraid to approach police in the U.S. because of cultural differences and language barriers.  Most of them do not know that there exists a special visa designed for victims of certain crimes called the U visa.  The purpose of the U visa is to provide eligible victims of crimes with temporary nonimmigrant status so that they may assist law enforcement agencies in criminal investigations and prosecutions. </p>
<p>Congress created the U visa in The Victims of Trafficking and Violence Prevention Act (VTVPA) of 2000 to encourage victims to report crimes and help law enforcement officials to investigate and prosecute criminal activities regardless of the victims’ immigration status.  Women and children are especially vulnerable to certain crimes such as human trafficking, sexual assault and domestic violence.  If a U visa petition is approved, the petitioner receives nonimmigrant status to live and work in the United States for up to four years.  Subsequently, qualified recipients may apply to adjust status to become a lawful permanent resident (green card) after three years of continuous presence in the U.S. as a U visa holder.  There are other eligibility requirements for a green card as well, including the ongoing duty to cooperate with law enforcement in the investigation or prosecution of the qualifying crime.   Additionally, other immediate family members of U visa recipients may also be eligible to live and work in the United States as derivative U visa recipients. These family members include: Unmarried children under the age of 21 of principal U visa recipients; Spouses of principal U visa recipients; Parents of principal U visa recipients under age 21; and Unmarried siblings under 18 years old of principal U visa recipients under age 21.</p>
<p>To apply for a U visa, one must file the USCIS Form I-918, Petition for U Nonimmigrant Status (Form I-918), and submit it to U.S. Citizenship and Immigration Services (USCIS) with all relevant documentation, including Form I-918B, the U visa law enforcement certification.  The Form I-918B is a requirement for the U visa and must be certified by a qualified law enforcement agency including a federal, state, local law enforcement agency, prosecutor, judge, or other authority that has the responsibility for the investigation or prosecution of a qualifying crime. Essentially, the law enforcement agency must certify that the petitioner was a victim of a qualifying crime, has specific knowledge and details of crime, has been, is being, or is likely to be helpful to law enforcement in the detection, investigation, or prosecution of the qualifying crime.  Qualifying crimes includes qualify for the U visa including murder, robbery, abduction, rape, sexual assault, kidnaping, incest, perjury, prostitution, obstruction of justice, etc. </p>
<p>The U visa is an extremely important incentive for victims of crimes to come forward to testify against the perpetrators.  Because of the complexity of U visa petitions, applicants should seek assistance from a legal representative or victim advocate. It is important to know that certification by a law enforcement agency does not guarantee approval of a U visa.  The USCIS must determine if other requirements of the U visa are met including whether the applicant has suffered substantial physical or mental abuse as a result of the subject criminal activity.  However for victims of serious crimes without legal status especially women and children, the U visa may be their only hope to fight back.

<p class="MsoNormal" style="line-height: normal;"><span style="font-size:130%;"><span style=";font-family:&quot;;" >My last Seattle Immigration Lawyer Blog post provided an introduction to the rather daunting process of obtaining a green card through <a href="http://seattleimmigrationlawyer.blogspot.com/2010/10/seattle-immigration-laywer-intro-to.html" rel='nofollow'>employment</a>.<span style="">  </span>This post will go a little deeper into the eligibility requirements.<span style="">  </span>Before you consider this route, you must have these two things going for you: a job offer from a U.S. employer (there are <i style="">limited </i>exceptions, including if you possess exceptional abilities or your work is in the national interest), and the employer must be generous enough to sponsor you. <span style=""> </span></span></span></p>
<p class="MsoNormal" style="line-height: normal;"><span style="font-size:130%;"><span style=";font-family:&quot;;" >If you have both of these, you are very fortunate indeed.<span style="">  </span>With some more luck, and if you do not make any missteps, you may be successful in eventually getting your green card, which will allow your spouse and any unmarried children under 21 to also be eligible for a green card, assuming they are all admissible to the U.S.<span style="">  </span>(And, after 5 years of having your green card, you will be eligible to apply for naturalization as a citizen.)<span style="">  </span></span></span></p>
<p class="MsoNormal" style="line-height: normal;"><span style="font-size:130%;"><span style=";font-family:&quot;;" >If your employer has a legal department (or outside counsel) that will be doing the labor certification process, that’s wonderful.<span style="">  </span>If not, you should not embark on this process without representation.<span style="">  </span>Consult with an experienced Seattle immigration lawyer because the rules are very strict and complex; they have also changed since a totally new system for labor certification was introduced in 2005 known as PERM. <span style=""> </span><span style=""> </span></span></span></p>
<p class="MsoNormal" style="line-height: normal;"><span style="font-size:130%;"><span style=";font-family:&quot;;" >Now, when an employer “sponsors” an immigrant, this entails going through labor certification, which essentially requires the employer to advertise and interview U.S. workers for the very job that you have been offered and reject all of these other candidates on lawful grounds.<span style="">  </span>Of course, there is a lot more to the labor certification process that I will discuss later, including getting a prevailing wage determination from the state, writing a very carefully crafted job description, following a strict timeline, submitting financial records, following different advertising requirements depending on the job, etc.<span style="">  </span>This is why an experienced immigration lawyer should be handling the process. <span style=""> </span><span style=""> </span></span></span></p>
<p class="MsoNormal" style="line-height: normal;"><span style="font-size:130%;"><span style=";font-family:&quot;;" >The good thing for the employer is that while Department of Labor rules require employers to pay for the labor certification process, including attorneys’ fees (though many do not follow this rule), the employer is not a financial sponsor of you, can always withdraw its green card petition for you, and, of course, is always free to fire you.<span style="">  </span>The thing that makes many employers nervous, besides simply the time and money involved, is that they will have to provide financial records to USCIS; however, this is only to make sure the business can afford to hire you.<span style="">  </span><span style="">  </span><span style="">  </span></span></span></p>
<p class="MsoNormal" style="line-height: normal;"><span style="font-size:130%;"><span style=";font-family:&quot;;" >As far as the offer of employment, it must be for a full-time and permanent or indefinite period.<span style="">  </span>The job must be in the U.S. from an employer permanently located in the U.S. <span style=""> </span>In addition, and this is crucial, you need to have a background that matches the qualifications for the job.<span style="">  </span>This is the most important factor for the government; it is not whether you have more skills than other candidates, or whether the employer likes you more.<span style="">  </span>And, of course, if labor certification is required, the result of the required recruitment process—ironically, undertaken <i style="">after</i> you have been offered the job—must be that there are no U.S. workers qualified for the job offered.<span style="">  </span></span></span></p>

<p class="MsoNormal"><span style="line-height: 115%;font-size:12pt;" >In my last two Seattle immigration lawyer posts, I wrote about the <a href="http://seattleimmigrationlawyer.blogspot.com/" rel='nofollow'>asylum route to a green card</a>.  A more common path to obtaining a green card is through marriage to a U.S. citizen or a U.S. green card holder (officially called a lawful permanent resident, which is known in immigration lingo as an “LPR”).<span style="">  </span>What follows is only a brief overview of the process but it should provide a taste of what to expect.<span style="">  (You should of course consult with an immigration lawyer regarding your specific situation.) </span>You will see that it is much easier, and, more importantly, much faster, if the petitioning spouse is a U.S. citizen.<span style="">  </span>This is because there is no waiting period for immediate relatives of U.S. citizens (which include spouses, parents, and unmarried children under 21).</span></p>
<p class="MsoNormal"><span style="line-height: 115%;font-size:12pt;" >Before I run through a few scenarios to describe the process, you should know that some immigrants are simply not eligible for adjustment of status (becoming a permanent residence).<span style="">  </span>In a future article, I will discuss some of the grounds for inadmissibility and whether waivers exist for them.<span style="">  </span>For now, readers should be aware that there are a plethora of these grounds, some obvious, such as if your last entry to the U.S. was illegal, and others less obvious, and you will want to figure out if one applies to you.<span style="">  </span>If one does, you’ll definitely want to consult with an experienced <a href="http://seattleimmigrationlawyer.blogspot.com/" rel='nofollow'>immigration attorney</a> about your particular case.<span style="">  </span></span></p>
<p class="MsoNormal"><span style="line-height: 115%;font-size:12pt;" >Regardless of your situation, the U.S. citizen or LPR spouse will need to prepare the visa petition.<span style="">  </span>This includes: the Form I-130, Petition for Alien Relative; Form G-325A, Biographic Information (one form for each spouse); photos of the petitioner (U.S. citizen or LPR) and beneficiary (immigrant); proof that petitioner is U.S. citizen or LPR; proof of a valid marriage, including a marriage certificate, and if there’s a previous marriage for either spouse proof that it was terminated; and filing fee of $355.</span></p>
<p class="MsoNormal"><b style=""><span style="line-height: 115%;font-size:12pt;" >Living In U.S. &amp; Married to U.S. Citizen</span></b></p>
<p class="MsoNormal"><span style="line-height: 115%;font-size:12pt;" >Now, in the case of an immigrant already living in the U.S. and married to a U.S. citizen, the U.S. citizen, as in all of these cases, starts the ball rolling.<span style="">  </span>In this situation, the U.S. citizen submits the visa petition (see I-130 and other documents above) simultaneously with the immigrant spouse’s permanent resident application (Form I-485).<span style="">  </span>Note that I-485 is filed at a different location than the I-130, so read the instructions!<span style="">  </span>(Reading the instructions for any immigration form is a must, along with making sure that you have the most up to date version.)<span style="">  </span>The I-485 will include, among other documentation, a medical report and an affidavit of support (Form I-864).<span style="">  </span></span></p>
<p class="MsoNormal"><span style="line-height: 115%;font-size:12pt;" >Once USCIS receives the I-130 and I-485, the immigrant will receive a fingerprint appointment notice, and then an interview appointment notice.<span style="">  </span>Since both the U.S. citizen and immigrant spouse are in the U.S. in this scenario, both must be at the interview.<span style="">  </span>The key issue at the interview is proving that the marriage is not a sham.<span style="">  </span>The intricacies of proving a bona fide marriage will be the subject of a future article.<span style="">  </span>Hopefully, the application for permanent residence will be granted at the interview.<span style="">  </span>(Note that a conditional residence will be granted if the marriage has been for less than 2 years by the time the interview occurs.)</span></p>

As per the same a black and white report would be expected from the consular officers on the qualified applicants. The report is to be send o the United States department of state. I have discussed the same briefly here under and is aimed at benefiting you. Hope the under mentioned would keep you updated on the latest from the United States department of State</p>
<p>The limits for the fiscal year 09, has been fixed as per the provisions of the INA Act (Sec 201). As per the said Immigration and Nationality Act (Sec 201), the annual minimum family sponsored preference limit is 226,000. However as per the same act the Upper limit for the preferred immigrants has been set to a maximum of 7% of the total applications received from the country for the employment based preference and the annual family sponsored preference. However, only 2% has been allotted for the dependent area limit.</p>
<p>The Sec 203 of the Immigration and Nationality Act, defines the preference of the family sponsored preferences as per the under mentioned.</p>
<p><strong> </strong></p>
<p><strong>First</strong> – The preference would be given to the unmarried children for the citizens and the number stands at 23,400 plus what ever is the surplus from the numbers allotted to the 4<sup>th</sup> preference.</p>
<p><strong>Second</strong> – The send in the line would be the spouses and children along with the unmarried children of the permanent residents of the United States.</p>
<p><strong>Third</strong> – Third in the line comes the children of citizens who are married in different countries and are have been staying there. The upper limit for this category has been fixed at 23400 plus the surplus of the first two preferences.</p>
<p><strong>Fourth</strong> – Siblings of adult United State citizens, and the upper limit of this preference e has been capped at 65,000. This category would also include the surplus of the previous 3 preferences.</p>
<p>There has been mentioned some preferences for the employment based immigrations as well.</p>
<p><strong>1.</strong> 28.6% of the world wide employment based preference level would be allowed as the first preference.</p>
<p><strong>2</strong>. People in profession who holds advanced degree. This category has been capped at the maximum of 28.6% of the world wide employment based preference level.</p>
<p><strong>3</strong>. The third category is for the skilled workers and the professionals. Again capped at 28.6% of the world wide employment based preference level.</p>
<p><strong>4</strong>. This category is for the special immigrants being capped at 7.1% of the total world wide level.</p>
