			<content:encoded><![CDATA[<p>For the first time in a decade, Germany has seen an increase in immigration into the country, according to numbers published by the national statistics office.</p>
<p>At the end of 2010, approximately 6.75 million foreign nationals were registered in Germany, bringing the immigrant population of Germany to just over 8 percent. This was a rise of 58,000 over the previous year.</p>
<p>More than a third of foreign nationals residing in Germany are from other European Union member states. </p>
<p>The largest group consisted of 21,600 Romanians, followed by large numbers of Polish and Bulgarian nationals.</p>
<p>In recent years Germany has had quite tough immigration controls. However, this may have to change in future; Due to an aging population there are fewer people in the workforce.</p>
<p>Germany may need to open its doors to skilled migrants to deal with skills gaps in the workforce.

<p>A family based immigration in to the United States is some thing that could be done easily. This is done if you could fulfill the under mentioned terms and conditions. In this kind of immigration the guardian angle happens to be the relative who is either already staying in the United  States, or is a lawful permanent resident already in the US.</p>
<p><strong>The above mentioned could be done in 2 ways (this is the IR category).</strong></p>

<ol>
<li>Some one who      is an immediate relative of an US citizen, which is a spouse,      widow or an unmarried child who essentially needs to be under the age of      21. This category could also be useful for the parents of an adult US      citizen.</li>
<li>People with a      returning resident status. This applies to people who have been previously      staying in the United        States as a permanent resident and now      is coming back after a stay in some other nation for a year.</li>
</ol>
<p>As far as the above mentioned is concerned (limited family based immigration), there are some preferences which are involved in the same. The hierarchy of the preferences are as per the under mentioned.</p>
<p><strong>Preference 1</strong> – Children of people who are already US citizens who are below the age of 21.</p>
<p><strong>Preference 2</strong> – The spouses of the lawful United   States citizens with or without their children, who are below the age of 21. However in the case of unmarried daughters there is a relaxation. Daughters even if they are over the age of 21 still they are permissible, as per the said provision.</p>
<p><strong>Preference 3</strong> – Next in the preference grid comes, the number for the children of a United States citizen whose children are married.</p>
<p><strong>Preference 4</strong> – Last but not the least the siblings of a person who has the status of a permanent resident in the United   States are also allowed as per the provision.</p>
<p>Be it the IR category or the preference category, the relative in the United States has to first submit a petition related to the immigrant visa. The said petition has to be essentially accompanied by the proof of your relation ship with the citizen who has filed in the petition.</p>
<p>Post the approval is received on the petition that has been filed in by the relative, who is either a citizen or a permanent citizen in the United States, the department of States would be considering to figure out if there is a number that is available to be given to you for the immigration related visa. However this is applicable only if your current residency is out side the United States. In case you are inside the United   States then, you could apply for a change in the status. That would involve a form called I – 485.</p>

<p>The J1 visa is issued to the foreign exchange students who have traveled to the United   States for the reason of getting some training or some sort of education. As per the clause of the J1 visa the people traveling to the United States on the J1 visa would be required to stay in the home country for the next two years post the completion of the training in the United States for which the visa was issued in the first place.</p>
<p>The basic reason for this requirement defined by the United States government, is that the person who has acquired the advanced skills and knowledge from the United States by the virtue of the exchange visitor program, he or she should go back to the home country and spread the knowledge to people there. But there could be a lot of reasons and requirements because of which the visitor might not be able to travel back. Under such situations there is a provision of waiver of such clause at the discretion of the United States government.</p>
<p><strong>This J1 visa waiver is suitable for the people, who falls in any of the under mentioned categories.</strong></p>
<ol>
<li>Like medical graduates who had originally entered in to the United States and now post the completion of the education they would like to stay back in the United States.</li>
<li>People who are foreign nationals and had come to the United States. For the purpose of participating in any of the government funded programs, the same would also apply to the programs those are funded by other countries in the United States or by other international organizations.</li>
<li>The people who are foreign nationals, who had attended the exchange program and are now required to go back to their home country but there the knowledge would be of little or no importance due to the lack of the resources there.</li>
<li>If the J1 visa holder is able to obtain a NOC or a no objection certificate from the government in his home country.</li>
<li>If the project the J1 visa holder is working on is of importance to the federal government or any of its agencies, in that case the federal government might choose to waive off the clause.</li>
<li>If by the compliance of the J1 visa clause would be subjecting the spouse and the children of the person to a lot of hardship and problem then again the case could be reviewed for a waiver. But under such a situation the children and the spouse of the person has to be a citizen or atleast a permanent resident of the United States.</li>

Normally these two types of visas are issued simultaneously. What that would mean for you is in case you are already holding a B1 visa and you wish to travel to the United States simply for pleasure for maximum of three months then in this case you need not apply for a fresh Visa, the old one should be good enough for you.</p>
<p>But please note there are a bunch of dos’ and don’ts associated with both the types of Visas. I would briefly touch upon them in the under mentioned manner.</p>
<p><strong>For a B1 visa traveler:</strong></p>
<p>1. The person would be eligible to conduct negotiations.<br />
2. He might solicit investment of different types or might try to enhance sales of products and articles of a different country.<br />
3. Discuss and plan the above mentioned with interested parties even create legal agreements related to the same.<br />
4. Attend participate or hold meetings.<br />
5. He would be permitted to interview people for the purpose of hiring.<br />
