Microsoft stresses importance of US H-1B visa for IT companies

This week, as employers began filing petitions for the popular US H-1B work visas, Microsoft stressed the importance of the visa in keeping America’s IT companies competitive.

“While the vast majority of our US workforce is comprised of US workers, the individuals we employ in H-1B status -educated at some of the best universities in the US and around the world – are crucial to our business,” said Brad Smith, general counsel & executive vice president, Legal & Corporate Affairs, Microsoft.

Current immigration law allows for a total of 85,000 new H-1B visas to be made available each government fiscal year.

Picking up where I left off last in discussing the Third Preference category, the subcategory of “Professionals” includes not only attorneys, doctors, engineers, teachers and architects, but also, generally anyone who has a degree and who is working in a field related to their education and/or experience background.

To qualify for the subcategory of “Skilled workers,” an immigrant must have at least two years of training or experience (no university degree required). As of November 2010, the priority date for “Professionals” and “Skilled workers” was January 22, 2005, meaning that if you have a priority date before 1/8/05, you are eligible for a visa number.

Only 140,000 immigrant visas are made available per year for immigrants, along with their spouses and children, who wish to immigrate based on their job skills. On top of that, there is a quota that limits every country to seven percent of the available green cards every year. (There is no quota for immediate relatives of U.S. citizens.) And, several categories (known as “preferences”) of employment-based immigrant visa petitions require that the sponsoring employer file a labor certification application with the U.S.

The Green Card Process

To draw the world’s ” brightest and the most excellent”, the Democratic Senators planned instant Green Cards for foreign people with higher degrees from American colleges and institutes and job offers. This is very good news for Indians as there is a large number of students going to the US every year.

In order to achieve this goal, a Green Card or a permanent residency will be right away available to any foreign student having an advanced degree from any U.S. college/institute of higher education. Vocational student are mostly in a field of technology, science, industrial, or mathematics. India has the most number of students in these fields.

In economic terms India is the main supplier of human capital or the skilled labour in the whole world. Germany supplies cars, UAE supplies oil, China supplies electronics and India supplies minds in fact great minds. Skilled labour is must for growth of any nation and in nation like India there is no shortage for it. Most of great minds want to settle in US because of better opportunities and more income. So for the permanent settlement there is a need of permanent immigration or in a sense a ticket to live in US permanently. This ticket is called the green card.
