US immigration adds more countries to list of eligible applicants for H-2A and H-2B visas

US Citizenship and Immigration Services (USCIS) announced last week that there have been five more countries added to the list of eligible nationals who can participate in the H-2A and H-2B programs in 2012. This brings the lists total to 58 countries. The list of Countries will be reviewed again one year from the date of publication.

The H-2A and H-2B programs allow US employers to bring foreign workers to the US in order to fill temporary agricultural jobs and temporary non-agricultural jobs.

Issuance of Prevailing Wage Requests Resumed

The U.S. Department of Labor has resumed issuance of Prevailing Wage Determination (PWD) after a few weeks of suspension of the service.  PWD is required in all PERM foreign labor application cases and is also used in other non-immigrant visa petitions such as H-1Bs and H-2Bs.  Recently, the service was suspended by the Labor Department temporarily in order for the agency to meet the requirements of a federal court order to process thousands of H-2B PWDs. 


The H 2B Visas Are Still Available

Did you know that under the following circumstances the H2B visa for the United States may be used for both Skilled and Unskilled work?

  1. An American employer, to handle the work load spikes of the peak months may choose to hire temporary staff. For that they can hire people using the option of the H2B visas.
  2. Also in case there is a one time occurrence situation for an employer in the United States, they may opt for the H2B visa.

The H2B visa is used for a number of works for the both the employers and the job seekers in the United States.
