The process of becoming a citizen of any other country is known as naturalization and is controlled by the Immigration and Naturalization Services (INS). To become a naturalized citizen, one needs to have and submit a legal document to live permanent in that particular country.

A K1 visa is generally applied for a fiancé visa which is non immigrant visa but it allows the person to enter into the country to marry. After marring each other, an application is made for the status for permanent residence. Obtaining the K1 visa i.e. the fiancé visa is a multi – step process. Firstly the citizen of any country files a formal written request for his permanent residency and immigration services. Once that approval is received by the local Government, the foreign fiancé will file a case and will give an additional documentation to the local embassy, take all the medical exams and the visa interviews for the same.

This service is forwarded to the National Visa centre for processing and then after approval is collected by beneficiary’s embassy. Fiancé visa is generally issued for the period of six months and is issued for the purpose of travelling in order to get married. People who wanted to apply for this type of immigration service must be 21 years of age or above, and the partner should also be permanently and well settled there. And only after the marriage the partner can go for the permanent residence there.

Today there is high anxiety level regarding the Fiance Visas. Many of the people find this way better and the easiest one in order to get settled in any of the foreign country. One can also contact the immigration experts for these visas. The petitions filed for these types of visas are quickly and accurately solved.

Work permit is a basic or the generic (without any brand) term for the legal authorization which allows one to have employment. It is generally given to that person who is not holding the citizenship of the country, but is permitted to work in the same country. He is also allowed to work under some of the terms and conditions i.e. under some jurisdictions that he is permitted legally to do the work.

There are many standard ways to apply for the work permit in any of the country and they are as following:

The training and the work experience arrangements.

Student internships.

GATS.

The business and commercial arrangements.

The sports people and entertainers arrangements.

The sectors based scheme.

Each of these processes requires its own different applications and the job offer from the employer in that country only. Some of the countries provide the work permit only to the people who are attached to the categories of arrangements above whilst they reject the other ones.

The work permit systems in some of the countries are replaced by the new points based immigration systems. In some of the smaller countries the work permit is managed by the Ministry of Manpower that has introduced an internet platform for work permit transactions. With the internet portal, the ministry is able to process many of the work permit applications within one working day alone.

In some of the countries for the permission of work it has been taken into account many of the things like skills (including all the education), work experience if ever in any other country had performed, and importantly the type of the job applied for. Some of the people have also been restricted for the duration of the time they are permitted to work as well as it depends on the type of the job. Usually high school students are offered the jobs for timings.

Indians who are thinking of migrating to the United States have a few options when it comes to the immigration process. If they have close relatives currently residing in the United States who are already permanent residents or citizens, they can have their family members sponsor them. Alternatively, if they have any special skills or work in a position which is in high demand in the United States, they may opt to apply for an employment-based visa.

There are five different categories of those eligible for employment-based visas with the code E1 (Employee First Preference) taking precedence over the other codes; namely E2, E3, E4 and E5. Those who have extraordinary skill in different industries i.e. arts, sciences, business can be considered for this category. Additionally, professors or researchers, and/or those who are currently being employed in the branch or subsidiary of a US employer may be eligible under E1.

However, there is a clause in immigration laws of the United States whereby they reserve the right to waiver or deem ineligible certain categories of applicants. If you had previously suffered from or are currently suffering from any communicable disease, have a history of violent behavior of mental illness, are a terrorist or have terror affiliations, have previously committed violent acts, then you would not be eligible for a green card.

The Immigration Department of the United States also visas for foreign religious workers; of which there are two different visas. Religious workers include those who have been given the right by their denomination to preside over religious worship. Only those who have taken life-long vows and have been ordained into the denomination are covered under the definition of religious workers. Examples are monks and nuns.

Religious workers who are filing petitions to migrate to the United States have to fulfill an important condition – they should at least have been a member of that particular denomination for at least two years prior to the application, and who have been working for the past two years in a professional capacity. The applicant should fill up form I-130 after which if the application has been approved, he will be notified of the next step in the immigration process.

One of the main concerns when E-B-5visa has to be applied is what amount is to be invested. Investment decision has to be after a great research and a wise initiative as it involves huge value. The other concern can said to be is to select the centre for investment. To enumerate there are around sixty regional centres in UK for investing in EB-5 program.

As investing in them is like a lifetime investment involving $500,000 so it has to be very well thought of after taking into consideration the various parameters to select the centres.

In the UK the rate of unemployment is very high so EB-5 visa has been there to create more jobs for thae local citizens. Therefore, the main intention in this program is to generate employment opportunity in order to develop the UK economy. It is also considered as an easy way to gain status of permanent residence of UK.

Now the concerns should be catered to one by one as to which centre should be considered after dealing with all the parameters. In depth study is required as the country is totally unknown. The role to be highlighted here is of the Immigration Expert.

So to start from following things should e considered:

Be in contact with any of the acquaintances in UK gaining information about their perception about your investment decision.

Make your database strong and gain all the information about best places to live in there and their respective employment rates.

Do your research about the scope for investment decisions in the country and current booming sectors.

Know which is the most profitable decision for you and how can you leverage on it such that you will be doing justice in all regards.

Make your budget and accordingly match the investment decisions so that they are compatible enough. Take into consideration investments, interest, permits, licensing, fees etc.

The things talked about are just to give a fair idea about the concept. There can be many other aspects on which an expert can throw a better light. The concept talked about here is not just a shorter or an easier pathway towards a better life, But with an objective to give your contribution towards an economy which is certainly alien to you. Therefore, it is necessary to review the business after initial two years basis the grant of permanent residence of UK.

One of the most popular and sought after visa for non immigrants’ skilled workers is H1-B visa, which provide them legitimate right to work in United States for a particular period of time. This is aspect is very problematic for migrants who are trying to apply for immigration and sponsorship. For such people EB-5 visa is considered as best alternative for H1-B visa.

It is very easy for a migrant who is living in United States for a considerable period of time to invest. This is because he would have gain a good understanding of the various aspects of the economy of the United States of America during his stay. He would have become more familiar with the functioning of economy. This knowledge of United States would help him in avoiding the culture shock which he would have otherwise faced. In these cases, getting accustomed and adjusted to the totally different culture of United States would be of prime concern.

Another advantage of this would be that he would have save some investment which could again be invested in United States economy. The task of researching and deciding about the regions to set the business and invest accordingly would be much more easy and simple if person have a good understanding of the economy.

Another advantage is that person would have proper understanding of local job market as well. The very basic requirement of getting EB-5 visa is that a minimum ten new jobs should be created for the local people and hence selecting right employees for jobs would not be so difficult. At the same time local job seekers would find it much easier to trust the immigrant as he is accustomed to local culture. This in turn will save a lot of money and time and subsequently would add to investment.

Since individual is already working in United States so he must have developed a vast professional network. This network can help him in promoting his business in easy fashion. An applicant can even work in collaboration with any American citizen.

Lastly an immigrant can be saved if he does not get involved in all deceitful and unlawful activities which might come in his way during the whole process of his venture.

It is always recommended for such profession to contact some good EB-5 attorney or any specialist in EB-5 who can help him in entire procedure.

The term Waiver stands for a kind of document provided to a person before a service is rendered by him. This waiver works as a security object for both the person as well as the provider.

‘Waiver’ holds the same significance in Visa Waiver Program too. Visa Waiver Program is a grant provided by the government of United States of America to the citizens of specific countries to travel United States for business or any other purpose for not more than 90 days without any Visa.

U.S. government has listed 34 countries under waiver program which are either the countries that possess higher economy or the developed countries.

A Pilot test of Visa Waiver Program was incorporated into Immigration and Nationality Act (INA) in year 1986 by the Immigration Reform and Control Act. This pilot program was made permanent on October 30, 2000 by a special Visa Waiver Permanent Program Act. Security of Visa Waiver Program was strengthened by the 9/11 Commission Act of 2007 which made the entry under this program more difficult.

The greatest advantage that a Visa Waiver Program can give is that any person that wishes to conduct his business in America can travel to United States without any visa.

Any individual applying for this program has to obtain an authorisation from the Electronic System for Travel Authorization (ESTA) before travelling. ESTA is an Automatic system that scrutinizes the eligibility of travellers wishing to visit United States under Visa Waiver Program. Application for the ESTA can be applied any time before your travel but it is highly recommended that its application should be submitted at the time of your travel plans.

Apart from the leverage that Visa Waiver Program provides, there are some issues to be taken care if you are applying for this program. You may not extend your status of being non-immigrant, if you are admitted once under this program. If you have violated any terms related to admission under this program then you cannot apply for the same anymore and in case if your admission is not accepted then you cannot take any judicial support for re-application.

Thus, if you fall under the privileged countries that come under Visa Waiver Program then you can surely apply for this facility that United States government provides.

It can be said that the most popular visa among Indians is H1B which is a working visa for foreigners. Most of the Indians H1B visa holders are software engineers. Although it is a quite hard to get the H1B visa, once you obtain it, it is like the starting point for you to get the Green Card of US.

Compared to Indians programmers and software engineers who come with other visas such as L1 and B1, their visas is not so flexible for changing jobs, which is the best fact of H1 visa. Most Indians obtain their work visas from company such as Wipro, Infosys, Satyam or TCS. But there are some who got their visas from Desi consultants.

There many advantages of H1 Visa. When you are working, you are able to change your employer, meaning that you can easily change your work at any time. Besides, if you get your H1 visa, it is valid and legal for 3 years and you can easily lengthen its validity for 3 years more.

Other advantage of H1 visa is after you get it, you can apply for US Green Card that starts with Labor certification after few months you join the company. But, you also need to know that H1 visa also has disadvantages.

The first one is, if you plan to switch your job, your new employer has to pay for the transfer fee but this is not a problem as if you are working with big companies, they will surely do not mind in paying the transfer fee for you. But, somehow, there are also some Indian companies that take money from you indirectly or claim a bond.

You should act fast to get this visa. This is because, there are a maximum number of quota of 65 000 H1 visas that get filled up rapidly and always done by lottery system. Always remember to be well prepared to file your H1 visa.

Lastly, put in mind to apply for your visa one year earlier so that you will not have problems getting your visa. Get everything ready, your US offer letter, passport and other documents by December.

How to Read Your US Visa?

It is really important that you are able to read and interpret the information on the United States visa document clearly and properly. This is not going to help you understand the information properly that is displayed on the visa document but would also help you understand what kind of a visa has been issued to you and not to forget, with that you would be able to avoid future troubles too.

Here is how you would be doing the same:

First from the top left corner you should look for the information related to, from where your visa was issued. This should be the place or rather the name of the city from where you had appeared for the interview with the visa officer.

Next you ought to check the Passport number on the visa document is printed correctly.

Next you need to check that your name is spelled correctly on the visa document. Even the smallest of the errors needs to be reported to the authorities immediately having failed to do the same could have serious consequences even up to refusal of entry into the United States after you have arrived at the port of entry.

Below the passport number would be your permitted umber of entries. “M” is for multiple entries and in case there is a number mentioned there you would be eligible to apply for entries up to that many times.

Below the entries would be the annotation field, this field is primarily indicated for extra information about your visa document. If you consider the example of the student visa then in this annotation field what you would be finding is the Sevis number and the name of the school in which you would have taken admission.

Above the annotation field would be the field where in the expiry date of the visa would be mentioned. The point to be noted here is that this date has got nothing to do with how long your stay is going to be in the United States. All that it specifies is that beyond that specified date you would not be able to request for an entry in to the United States basis that visa, and you would have to procure or have a new one approved.

Above that your date of birth would be mentioned again the smallest of the errors here needs to be reported

Above that is mentioned is the Visa type and the class of the visa. The class is dependent on the purpose of your travel, and could be B1, J1 so on and so forth. The alphabet “R” would signify passport type Regular.

If you are a student and no matter what your plan is to study in the United States starting from learning English in an ESL school or obtaining a degree from one of the American Universities on any subject under the sun, the bottom line is you would be required to obtain an F1 student visa for your self to get into the United States as a student.

It’s important that I mention that almost any one irrespective of the age of the person or his educational background might choose to apply for an F1 student visa. Also the procedure for the same is fairly simple and goes as per the under mentioned. Also you ought to understand that this is different than the exchange student visitor program that the United States patronizes by the recognized J1 visa program which is primarily a sponsored program and has a whole bunch of different details attached with it.

Download the F1 student visa guide for the purpose of application.

Now once that is done then you need t decide up on where in the United States you would choose to stay while you study

Now you need to choose up on the type of the school that you want to get an admission into. Like a college, a university, or may be a graduate school or an ESL school to learn English.

Now you need to get in touch with the school and initiate the admission process in to the same.

Once the school has accepted your admission request they would be issuing you a I 20 form. Please note that this I 20 form, is the going to be the most important part of the paper work that you prepare for the F1 student visa application.

Now you need to apply with the I 20 form to the United States embassy or Consulate for the F1 student visa, to the United States. Also please note that in case you are already in the United States than there are provisions that you would not be required to travel back to the home country. While your visa status is changed to that of a student.

While you travel to the United States on a F1 student visa for your studies. The United States government would allow you to work there legally too, for a limited number of hours every week to help you collect the money for the studies there.

Getting an admission to one of the schools in the United States and then getting the visa approved basis that to get in to the United States on an F1 visa is really the easy part. It’s to be noted that the F1 visa is not a sponsored program, as in the case of the J1 visa. Thus the visitor has to bear all the related expenses himself during his stay in the United States. Thankfully the United States government is considerate about this and to help the students during the stay they are allowed to work for limited number of hours.

Thus a lot of the students choose to take up driving as a profession during this period. As this profession fetches them more money than any other job that they would be eligible for. Though every state has a different set of rules and procedures related to the issuance of the driving license but the basics are as follows.

There are 2 steps for the same.

Pass the written test.

Pass the road test.

The procedure to get the Drivers license is.

Go to the DMV office with a prior appointment for a prompt service.

Now submit the fee along with the completed form for the test.

A thumb print would also be required from you.

Have your picture clicked.

You would be required to provide your SSN and proof of your date of birth, along with your passport.

Now you are good to appear for the written test.

The written test – A fee of $12 is required for the same, and you would be able to attempt thrice basis the amount. Normally there are 36 questions related to traffic laws and signs and its essential you have atleast 31 correct answers to pass the test. Once this is passed, then you need to appear for the eye test. Upon successful completion of the same, you would be eligible to be issued the temporary driving permit. You can use the same to practice driving.

The road test – It’s the practical part of the tests and is the most important part. In this part you would be tested for your carefulness and your ability to drive safely on the streets. It’s not going to take long but is a 100 marks test in which the minimum passing score would be 70%. In this one also you would be given three chances to pass the test in case you flunk in the 1st attempt.
